Terms of Use

These terms govern your use of Sweepr, an iOS and iPadOS application published by Davyd Hruts. Installing or using the app means you accept them. This document is also the End User Licence Agreement for Sweepr.

1. Licence

You are granted a personal, non-transferable, non-exclusive licence to use Sweepr on any Apple device that you own or control, as permitted by the Usage Rules in the App Store Terms of Service, except where the app is made available to other accounts belonging to you through Family Sharing or volume purchasing. You may not redistribute, sell, rent, reverse engineer or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it.

You confirm that you are not located in a country subject to a United States embargo or designated by the United States as supporting terrorism, and that you are not listed on any United States list of prohibited or restricted parties.

2. What the app does to your files

Sweepr deletes and rewrites items in your photo library at your instruction. Understand clearly what that means:

• Deletion. Every deletion is confirmed through the system dialog presented by iOS. Deleted items go to Recently Deleted, where iOS keeps them for thirty days before removing them permanently. After that they cannot be recovered by Sweepr or by anyone else.
• Compression. Compression writes a new, smaller file and moves the original to Recently Deleted. The new file keeps the original resolution, creation date, location and album membership. The original remains recoverable for thirty days through the Photos app.
• Backups are your responsibility. Please make sure your library is backed up, through iCloud Photos or otherwise, before you run a large session. This is ordinary prudence with any tool that changes files.

3. Free use and Pro

Sweepr can be used free of charge. The free tier allows fifty swipes per week, and includes compression for photos and video, which is not a paid feature. A compression spends one of those weekly swipes in the same way any other decision does.

Sweepr Pro removes the weekly limit, unlocks the detailed statistics, and loads photos from iCloud further ahead of the current card.

4. Subscriptions and purchases

Pro is offered as an auto-renewing subscription or as a one-time purchase:

• Weekly, $3.99 per week, with the first 3 days free.
• Monthly, $6.99 per month.
• Yearly, $24.99 per year, with the first week free.
• Lifetime, $49.99 once. This is a one-time purchase and not a subscription. It does not renew.

Prices are those of the United States storefront. Apple converts them for other countries, and some countries are priced individually. The price shown to you inside the app before you confirm is the price that applies.

Auto-renewal. A subscription renews automatically at the end of each period unless it is cancelled at least twenty four hours before the period ends. Your Apple Account is charged for renewal within twenty four hours of the end of the current period. You can manage or cancel a subscription at any time in Settings, your name, Subscriptions on your device. Cancelling stops the next renewal; it does not shorten the period you have already paid for.

Free trials. If a subscription includes a free trial, any unused part of the trial is forfeited when you buy a subscription of that kind. Cancelling before the trial ends means you are not charged.

Refunds. Purchases are processed by Apple, so refunds are handled by Apple and governed by its policies. Request one at reportaproblem.apple.com. The developer cannot issue refunds directly.

Restoring. A purchase is tied to your Apple Account and can be restored on any device signed in to it, using Restore Purchases in the app.

5. Changes to the app

Features may be added, changed or withdrawn as the app develops and as Apple changes iOS. If a feature you paid for is withdrawn from the plan you hold, you will be told in the release notes.

6. No warranty

Sweepr is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. It is not guaranteed to be uninterrupted or error free.

7. Limitation of liability

To the fullest extent permitted by law, the developer is not liable for indirect, incidental, special or consequential damages, or for any loss of data, arising out of your use of Sweepr. Total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

If you are a consumer resident in the European Union or the United Kingdom, nothing in this agreement removes or reduces your statutory rights, including your rights where digital content is not as described, not of satisfactory quality or not fit for purpose, and your right to a remedy for damage caused by a lack of conformity. Where those rights conflict with the paragraph above, those rights prevail.

8. Apple

This agreement is between you and Davyd Hruts, not with Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. In the event of any failure of the app to conform to a warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.

Maintenance and support for Sweepr are provided by Davyd Hruts alone. Apple has no obligation to provide any.

Any claim relating to Sweepr, including product liability, a failure to meet a legal or regulatory requirement, and any claim arising under consumer protection or privacy law, is the responsibility of Davyd Hruts and not of Apple. If a third party claims that Sweepr infringes its intellectual property, Davyd Hruts alone will investigate, defend, settle and discharge that claim.

Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

9. Termination

This licence ends if you stop using the app or delete it. Sections 6, 7 and 8 survive.

10. Governing law

These terms are governed by the laws of Ukraine, without regard to conflict of law rules, and without depriving you of any mandatory consumer protection of the country in which you live. If you are a consumer, you may also bring proceedings in the courts of the country where you live.
